Privacy Policy

Modus is operated by Clarity Invest Pty Ltd (ABN 17 672 145 596) ("Modus", "we", "us"). This policy explains how we collect, use, disclose and protect personal information, in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
Modus is a restricted, two-party communication and record-keeping platform for separated parents, including parents managing communication connected to family violence matters, court orders and child-related legal contexts. This policy applies to the Modus app, this website, and our support and account-request processes.
Our privacy commitments
We do not sell personal information or message content. We do not use message content for advertising or behavioural profiling. We do not train AI models on message content without your explicit, separate consent. Access to a communication space is restricted to its two authorised members, subject to the exceptions described below.
What we collect
Account information: email address, display name, password (stored as a salted hash, never in plain text), and authentication logs.
Communication records:messages and attachments you send, and records you or the other member create in your space (children's details, legal context, communication rules, flags and breach labels).
Audit and activity data: timestamps, message verification hashes, read receipts, export events, and a log of changes to rules, flags and account status within your space.
Device and technical data: IP address, device type, browser or app version, and push-notification tokens, collected automatically to operate and secure the service.
Subscription and purchase data: whether your space has an active subscription, the subscribed plan, renewal/expiry dates, and which member is currently the billing contact. Payment details (card numbers etc.) are never collected or seen by us — purchases are handled entirely by the Apple App Store or Google Play and by our subscription-management provider, which tells us only the subscription status above, not your payment method.
Support and requests: anything you tell us when you contact support, submit a safety report, or make an account deactivation, deletion or export request.
Website and waitlist data: contact details you submit through the waitlist or contact forms on this website, with your consent.
Sensitive information
Records you create in Modus may include sensitive information within the meaning of the Privacy Act — for example, information about family violence, health, or a child. We only collect this information because you or the other member of your space enter it, and only to provide the record-keeping service you have both signed up for. We do not use it for any other purpose.
How we use it
Solely to provide the service: delivering messages between the two authorised members of a communication space, preserving an intact and verifiable record, generating exports you request, sending you service and account notifications, responding to support and safety reports, and maintaining the security and integrity of the platform. We do not use your information for advertising, resale, or unrelated marketing without your separate consent.
Who we share it with
Message and record content in your space is visible only to the two authorised members of that space. We disclose personal information to:
Service providers who host and operate the platform under confidentiality and data-handling obligations, including our database, authentication and file-storage provider, our application hosting provider, our transactional email provider, our error-monitoring provider, our subscription-management provider (which coordinates in-app purchases with the Apple App Store and Google Play and tells us only the subscription status described above), and Apple/Google push-notification services (used only to deliver a generic notification — never message content — to your device).
Legal and safety exceptions:where required by law, in response to a valid legal process (such as a subpoena or court order), or where we reasonably believe disclosure is necessary to prevent a serious threat to someone's life, health or safety.
We do not sell personal information, and we do not disclose message content to third parties for advertising or marketing purposes.
Overseas disclosure
Some of our service providers may store or process data on servers located outside Australia. Where this occurs, we take reasonable steps to ensure those providers protect your information consistently with the Australian Privacy Principles, including through contractual data-protection commitments.
Security
We use technical and organisational safeguards including encrypted connections, private (non-public) storage for attachments, access-controlled and logged systems, and independent database-level enforcement of message immutability. See our Safety & Security page for detail.
Retention
Because the record is designed as shared evidence, messages cannot be edited or deleted by either party once sent. Account deactivation, deletion and export requests are reviewed rather than actioned instantly, because the other member of your space may rely on the record, and legal retention obligations may apply. Your rights and choices
You can ask us to access or correct the personal information we hold about you, request deactivation, deletion or export of your account (see Account Deletion Request), and opt out of non-essential marketing communications at any time. If you believe we have mishandled your personal information, you can lodge a complaint with us at privacy@modusparenting.com, or with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au if you are not satisfied with our response.
Children
Modus is designed for adult users. Children are not intended users and should not create accounts. A child's details may appear in a space only because an adult user has recorded them as the subject of parenting communication.
Cookies and analytics
This website uses minimal, privacy-conscious analytics to understand traffic and improve the site. We do not use tracking for advertising or sell website analytics data.
Changes to this policy
We may update this policy as the product or applicable law changes. Material changes will be notified in the app or by email before they take effect. The "last updated" date above reflects the current version.
