Data Retention Policy

Modus is a record-keeping platform operated by Clarity Invest Pty Ltd (ABN 17 672 145 596). Its core promise is that the shared communication record remains intact for both members of a space. This policy explains what is retained, for how long, and what happens when you ask us to delete your data.
Messages, attachments and audit data
Messages, attachments, flags, breach labels and audit events are retained for the life of a communication space. Neither member can edit or delete them, because both members may rely on the record — including as evidence in legal or safety-related matters.
Account-level data vs. shared-space data
Your account profile (email, display name, login credentials) is separate from the shared record in your space. Your account can generally be deactivated or deleted on request. The shared record — messages sent between you and the other member — may need to be retained even after your account is closed, because the other member may still rely on it, or because a legal retention obligation applies.
Reasons we may need to retain data
Even after a deletion request, we may retain some data where:
the other member of your space relies on the shared record; there is an active or reasonably anticipated court proceeding, subpoena or legal hold; a safety report involving your account is under review; we have a statutory obligation to retain the information; or retention is necessary to investigate suspected fraud, abuse or a breach of our Terms of Use.
What happens when you request deletion, deactivation or export
Requests are reviewed rather than actioned instantly. We aim to complete our review and respond within 30 days. Where data can be deleted or de-identified, we will do so. Where data must be retained for a reason above, we will tell you what is being retained and why. See Account Deletion Request for how to submit a request.
Where full deletion of your account isn't possible because the shared record must be retained, we will de-identify what we can — for example, removing your contact details from your profile — while the message content itself, which forms part of the other member's record too, is retained.
Backups
Deleted data may persist for a limited period in encrypted backups used for disaster recovery before being permanently purged in the ordinary backup rotation cycle.
Exports
Export files you generate are stored privately in your space, and access to them is logged in the audit trail.
Website and waitlist data
Contact details submitted through the waitlist or contact forms on this website are retained until you ask us to delete them, or until they are no longer needed for the purpose you provided them.
